License to Your Content

By posting or sharing Content on the Service, You grant Sarah Cosmetics Ltd a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display Your Content in connection with operating and promoting the Service.

This license allows Us to:

  • Take action against users who repeatedly violate these Terms
  • Cooperate with law enforcement if Content is illegal

We are not obligated to monitor Content, and We are not responsible for Content posted by users.

The Service, including all content, features, functionality, trademarks, service marks, logos, trade names, and visual design (“Company Content”), is owned by Sarah Cosmetics Ltd, its licensors, or other providers of such material and is protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms grant You a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only. You may not:

Purchases and Orders

Product Information

  • We reserve the right to correct errors in product information or pricing
  • We may limit quantities available for purchase

Ordering Process

When You place an Order:

  1. You select Goods and add them to Your basket
  2. You provide delivery and payment information
  3. You review and confirm Your Order
  4. We send You an Order confirmation email

Important: The Order confirmation email is an acknowledgment of Your Order, not an acceptance. We accept Your Order when We dispatch the Goods or provide access to digital services. We may refuse or cancel Orders at Our discretion.

Pricing and Payment

  • All prices are in British Pounds (GBP) and include VAT where applicable
  • We reserve the right to change prices at any time, but price changes will not affect confirmed Orders

Order Acceptance and Cancellation by Us

If We cancel Your Order after payment, We will refund the full amount within 14 days.

Delivery

Delivery Information

  • Delivery is available within the United Kingdom
  • Delivery times are estimates and not guaranteed
  • Risk of loss passes to You upon delivery
  • You must provide accurate delivery information
  • We are not responsible for delays caused by third-party couriers or circumstances beyond Our control

Delivery Charges

Delivery charges are displayed at checkout and added to Your Order total.

Failed Delivery

If delivery fails because You provided incorrect information or were unavailable to receive the Goods, We may:

  • Charge You for re-delivery costs
  • Return Goods to Us, in which case You may forfeit Your right to cancel
  • Treat the Order as cancelled if You do not arrange re-delivery within a reasonable time

Right to Cancel (14-Day Cooling-Off Period)

Cancellation Rights for Consumers

If You are a Consumer purchasing Goods online, You have the right to cancel Your Order without giving any reason within 14 days under the Consumer Contracts Regulations 2013.

The 14-day cancellation period begins:

  • For Goods: From the day You (or a third party You nominate) receives the last item in Your Order
  • For Subscriptions: From the day You enter into the contract

Effects of Cancellation

If You cancel, We will refund all payments received from You, including delivery charges (except additional costs if You chose a delivery method other than Our standard delivery).

Refund timing:

  • We will process Your refund within 14 days of receiving the Goods back or proof that You have sent them back
  • We may withhold the refund until We receive the Goods or You provide proof of return

Your Obligations When Cancelling

If You cancel, You must:

Condition of Goods:

  • You are liable for any diminished value of Goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning
  • Goods must be returned in resalable condition with original packaging when possible

Exceptions to Cancellation Right

Your right to cancel does NOT apply to:

  • Cosmetics or hygiene products that have been unsealed, opened, or used
  • Goods made to Your specifications or clearly personalised
  • Goods that deteriorate rapidly or expire quickly
  • Digital content if You agreed to immediate delivery and waived Your cancellation right
  • Subscriptions after the initial cancellation period has expired

Returns and Refunds

Faulty or Misdescribed Goods

Your statutory rights as a Consumer are not affected by Our returns policy. If Goods are faulty, not as described, or not fit for purpose, You have the right to:

  • Within 30 days: Reject the Goods and receive a full refund
  • After 30 days: Request a repair or replacement. If repair or replacement is not possible or fails, You may receive a full or partial refund

Returning Goods

To return Goods:

  2. Provide Your Order number and reason for return
  3. We will provide return instructions
  4. Pack the Goods securely with original packaging when possible
  5. Send to the address We provide

Refund Processing

  • Refunds will be processed within 14 days of receiving returned Goods
  • Refunds will be made to Your original payment method
  • We will notify You by email when the refund is processed

Non-Returnable Items

Due to hygiene and safety reasons, the following items cannot be returned unless faulty:

  • Opened or used cosmetics products
  • Unsealed hygiene products
  • Products without original packaging (unless damaged in transit)

Subscriptions

Subscription Plans

We offer Subscription plans that provide recurring deliveries or access to benefits. When You subscribe:

  • You authorise recurring charges to Your payment method
  • Subscription fees are charged at the start of each billing period
  • Billing periods may be monthly, quarterly, or annually as specified
  • We will notify You of Subscription fees and terms before You subscribe

Subscription Terms

Billing:

  • Your first payment is charged when You subscribe
  • Subsequent payments are charged automatically on the renewal date
  • We will notify You before charging if prices increase
  • You must keep Your payment information current

Changes to Subscriptions:

  • We may change Subscription benefits, features, or pricing with reasonable notice
  • Price increases will be communicated at least 30 days in advance
  • You may cancel before changes take effect if You disagree with them

Cancelling Your Subscription

Your Cancellation Rights:

  • You may cancel Your Subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You will not be charged for subsequent periods after cancellation
  • No refunds for partial billing periods (unless required by law)
  • You retain access to Subscription benefits until the end of the paid period

How to Cancel:

  • Log into Your Account and cancel through Account settings (when available)

  • We will confirm Your cancellation by email

Consumer Cancellation Rights:

  • As a Consumer, You have a 14-day cooling-off period from the date You subscribe
  • You may cancel within this period for a full refund of any payments made
  • After the cooling-off period, standard cancellation terms apply

We May Cancel Your Subscription If:

  • Your payment fails and You do not update Your payment information
  • You breach these Terms
  • We discontinue the Subscription service (with reasonable notice and pro-rata refund)

Failed Payments

If a Subscription payment fails:

  • We will attempt to process payment again
  • We will notify You to update Your payment information
  • We may suspend or cancel Your Subscription after multiple failed attempts
  • You remain responsible for any unpaid fees

Feedback and Suggestions

Your Feedback

We welcome and encourage You to provide feedback, comments, suggestions, and ideas about the Service (“Feedback”). By submitting Feedback, You acknowledge and agree that:

  • Your Feedback is voluntary and non-confidential
  • We may use, implement, and commercialise Your Feedback without compensation to You
  • We are not obligated to implement or respond to Your Feedback
  • We own all rights to any improvements, modifications, or developments based on Your Feedback
  • You waive any intellectual property rights You may have in the Feedback

We appreciate Your input, but please do not submit Feedback that contains confidential information or that You expect to receive compensation for.

  • Employees of Sarah Cosmetics Ltd and their immediate families are excluded
  • Additional restrictions may apply as specified in Promotion Rules

Disputes: Our decision on all Promotion matters is final. We reserve the right to disqualify entries that violate Promotion Rules or these Terms.

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.   • Fraud or fraudulent misrepresentation
  • Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession)
  • Breach of the terms implied by sections 9, 10, 11, 13, and 14 of the Consumer Rights Act 2015 (relating to description, satisfactory quality, fitness for purpose, samples, and models)
  • Defective products under the Consumer Protection Act 1987
  • Any other liability that cannot be excluded or limited under UK law

For Consumer Contracts:

Subject to the above, if You are a Consumer:

  • We are responsible for losses You suffer that are a foreseeable result of Our breach of these Terms or Our negligence, but not for unforeseeable losses
  • We are not responsible for indirect or consequential losses that are not foreseeable at the time You purchased the Goods
  • We do not exclude or limit Our liability for losses that result from Our negligence or failure to use reasonable care and skill

For Business Users:

If You are not a Consumer (i.e., You are purchasing for business purposes), then to the maximum extent permitted by law:

  • Our total liability to You for all claims arising from or related to the Service shall not exceed the amount You paid Us in the 12 months prior to the event giving rise to liability, or £100, whichever is greater

Without limiting the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

For Consumers:

If You are a Consumer, Your statutory rights are not affected by this section. This includes Your rights under the Consumer Rights Act 2015 regarding Goods being of satisfactory quality, fit for purpose, and as described.

Indemnity

If You are using the Service for business purposes, You agree to indemnify, defend, and hold harmless Sarah Cosmetics Ltd, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or rights of a third party
  • Your use of the Service
  • Your Content or User-Generated Content

This indemnification obligation will survive termination of these Terms.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Disputes Resolution

Informal Resolution

Jurisdiction for Consumers

If You are not a Consumer, any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Alternative Dispute Resolution

If You are a Consumer and are not satisfied with Our response to a complaint, You may be able to refer Your complaint to an Alternative Dispute Resolution (ADR) provider. We will provide details of an appropriate ADR provider if requested.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Entire Agreement

These Terms, together with Our Privacy Policy and any other policies referenced herein, constitute the entire agreement between You and Sarah Cosmetics Ltd regarding Your use of the Service and supersede all prior agreements and understandings.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
